               Regular Meeting Shell Rock City Council

                                   March 4, 2008

 

              Mayor Larry Young called the regular meeting to order in the City Hall with the Pledge of Allegiance at 7:00 p.m.  Council members Donald Bonzer, Benjamin DeWitt, Glen Kliebenstein, and Rosalee Meyer were present.  Council member Steve Nieman was absent.  There were eight people in the audience.

 

              Motion by Kliebenstein seconded by Meyer to approve the agenda with any additions.  Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-Nieman.  Motion carried.

 

              Motion by DeWitt seconded by Kliebenstein to approve the consent agenda that included:  The minutes of February 5, 2008, the payment of the bills, and the financial reports for the month of January, 2008.  Roll Call Vote:  Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-Nieman.  Motion carried.

 

              Mayor Young opened the public hearing on the proposed 2009 fiscal year City of Shell Rock budget at 7:01 p.m. with eight people in the audience.  There were no objections or comments either written or oral and the hearing was closed at 7:02 p.m. 

 

              Resolution 007-2008 was introduced by Meyer seconded by DeWitt:  A RESOLUTION ADOPTING THE BUDGET FOR THE CITY OF SHELL ROCK AND CERTIFICATION OF CITY TAXES FOR THE FISCAL YEAR ENDING JUNE 30, 2009.  Roll Call Vote:  Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-Nieman.  Motion carried.

 

              Elizabeth Bingham from the Shell Rock Development Corporation was in attendance and presented the council with an update on the Parks Galore and a Whole Lot More Project.

 

              Mary Hamilton from the Shell Rock Pool Board was present and asked the council for a donation of one family pool pass for the Shell Rock Elementary PTO raffle.  Motion by Bonzer seconded by DeWitt to donate one family pool pass to the Shell Rock PTO for their fundraiser this month.  Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-Nieman.  Motion carried.

 

              Sherry Schrage from Butler County Visions of Well-Being asked the council for a donation for this non-profit organization.  Motion by DeWitt seconded by Meyer to donate $100 per year for a total of three years to the Butler County Visions of Well-Being.  Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-Nieman.  Motion carried.

 

              Sherwin Smith from the Shell Rock Coon Hunters Association was present and asked the council for permission to make repairs to the Old Creamery Building owned by the City in exchange for this organization holding their meetings there.  Motion by Kliebenstein seconded by DeWitt to allow the Shell Rock Coon Hunters to make the necessary repairs to the Old Creamery Building owned by the City of Shell Rock in exchange for the Coon Hunters being able to use this building through December 31, 2013.  Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-Nieman.  Motion carried.

 

              Motion by Bonzer seconded by Meyer to appoint Dr. Todd Shoover as the Shell Rock Ambulance Medical Director.  Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-Nieman.  Motion carried.

 

              Resolution 008-2008 was introduced by DeWitt seconded by Bonzer:  A RESOLUTION SETTING THE DATES AND FEES FOR SPRING CLEAN UP 2008.  Dates for Spring Clean Up are April 21-23, 2008.  Roll Call Vote:  Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-Nieman.  Motion carried.

 

              Resolution 009-2008 was introduced by Kliebenstein seconded by Bonzer:  A RESOLUTION APPROVING THE WAGES FOR CITY EMPLOYEES FOR THE FISCAL YEAR STARTING JULY 1, 2008.  The following wage is effective immediately:  Park Maintenance Worker Jim Hegg $9.24 per hour.  The following wages are effective July 1, 2008:  Police Chief Louis Staudt $38,483 per year + 4th of July Celebration pay of $400.00, Public Works Director/Co-Zoning Administrator Mike Tellinghuisen $20.83 per hour + overtime, Utility Worker David Green $13.86 per hour + overtime, City Clerk/Co-Zoning Administrator Marilyn Hardee $36,110 per year, Deputy City Clerk Rachel Nieman $12.76 per hour, Meter Reader Barbara Hawley $2,482 per year, Library Director Diane Harms $10.85 per hour, Assistant Librarian Debra Heidemann $9.44 per hour, Library Aide Susan Kaus minimum wage + .20 per hour.  The remaining pay to stay the same:  Park & Rec Director Theresa Pothast $10.00 per hour and the person taking minutes is $40.00 per meeting.  Mileage reimbursement .24 per mile.  Roll Call Vote:  Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-Nieman.  Motion carried.

 

              Resolution 010-2008 was introduced by Kliebenstein seconded by DeWitt:  A RESOLUTION AUTHORIZING THE MAYOR TO SIGN THE IOWA DEPARTMENT OF TRANSPORTATION FEDERAL-AID AGREEMENT FOR A CITY HIGHWAY BRIDGE PROJECT.  Roll Call Vote:  Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-Nieman.  Motion carried.

 

              Ordinance Number 305 was introduced for its first reading by DeWitt seconded by Meyer:  AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF SHELL ROCK, IOWA, 2003, BY AMENDING PROVISIONS PERTAINING TO RESIDENTIAL SOLID WASTE COLLECTION FEES.  Roll Call Vote:  Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-Nieman.  Motion carried.

 

              Ordinance Number 306 was introduced for its first reading by Meyer seconded by Kliebenstein:  AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF SHELL ROCK, IOWA, 2003, BY AMENDING PROVISIONS PERTAINING TO SEWER SERVICE RATES.  Roll Call Vote:  Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-Nieman.  Motion carried.

 

              City Attorney Bruce Toenjes discussed the findings of the court case that Robert & Linda Brede had filed against the City of Shell Rock and the Shell Rock Board of Adjustment.  The Mayor and Council directed the City Attorney to file a motion to amend or enlarge the courts

finding and judgment.

 

              Motion by Bonzer seconded by Kliebenstein to adjourn at 9:00 p.m.  Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-Nieman.  Motion carried.
