Regular Meeting Shell Rock City Council

                                     October 6, 2009

 

              Mayor Larry Young called the regular meeting to order with the Pledge of Allegiance at 7:00 p.m. with council members Donald Bonzer, Benjamin DeWitt, Glen Kliebenstein, and Steven Nieman present.  Council member Rosalee Meyer was absent.  There were fifteen other people present. 

 

              Motion by DeWitt seconded by Kliebenstein to approve the agenda with any addition.  Ayes-Bonzer, DeWitt, Kliebenstein, and Nieman.  Nays-None.  Absent-Meyer.  Motion carried.

 

              Motion by Kliebenstein seconded by Nieman to approve the consent agenda that includes:  Minutes of September 8, 2009, Payment of the Bills, and the Financial Reports for the month of August, 2009.  Roll Call Vote:  Ayes-Bonzer, DeWitt, Kliebenstein, and Nieman.  Nays-None.  Absent-Meyer.  Motion carried.

 

              Mayor Young opened the public hearing at 7:02 p.m. with fifteen people present for the consideration of an application for rezoning from “A-1” Suburban Agricultural District to “R-2” Low Density Residential District for the legal description as follows:  The Southwest Quarter of the Southwest Quarter (SW ¼. SW ¼.) of Section 11, Township 91, North Range 15 West of the 5th P.M., Butler County, Iowa, EXCEPT beginning at a point on the section line that is North 0°00’00” East, 19.00 feet from the Southwest corner of said Sec. 11, thence North 0°00’00” East 1293.33 feet along the west line of the SW ¼ of the SW ¼ said Sec. 11, thence South 89°02’00” East 1020.07 feet to the centerline of Butler Center Road, thence South 38°38’00” West 1633.62 feet along said centerline to the point of beginning; and Outlot 62 of the Subdivision of the Northwest Quarter of the Southwest Quarter (NW ¼ SW 1/4 ) of the Section 11, Township 91, North, Range 15 West of the 5th P.M.  There were no objections either written or oral and there were two positive comments from the audience.  The hearing was closed at 7:04 p.m.

 

              Ordinance Number 317 was introduced for its first reading by DeWitt seconded by Kliebenstein:  AN ORDINANCE AMENDING THE ZONING ORDINANCE OF SHELL ROCK, IOWA, PROVIDING FOR REZONING OF AN AREA FROM “A-1” SUBURBAN AGRICULTURAL TO “R-2” LOW DENSITY RESIDENTIAL.  Roll Call Vote:  Ayes-Bonzer, DeWitt, Kliebenstein, and Nieman.  Nays-None.  Absent-Meyer.  Motion carried.

 

              Resolution 028-2009 was introduced by Kliebenstein seconded by DeWitt:  A RESOLUTION ADOPTING THE POLICY ON THE PROHIBITION ON THE USE OF EXCESSIVE FORCE.  Roll Call Vote:  Ayes-Bonzer, DeWitt, Kliebenstein, and Nieman.  Nays-None.  Absent-Meyer.  Motion carried.

 

              Resolution 029-2009 was introduced by Nieman seconded by Bonzer:  A RESOLUTION OF THE CITY COUNCIL OF SHELL ROCK, IOWA, AWARDING THE LOWEST MOST RESPONSIBLE BID TO WATERTIGHT CONSTRUCTION FOR PROJECT NUMBERS FIVE AND SIX IN THE SHELL ROCK HOUSING REHABILITATION PROGRAM.  Roll Call Vote:  Ayes-Bonzer, DeWitt, Kliebenstein, and Nieman.  Nays-None.  Absent-Meyer.  Motion carried.

 

              The new playground equipment purchased by the Vision Iowa Grant through the Shell Rock Development Corporation will be installed on October 22, 2009 and volunteers are needed.

 

              The Boyd Building Committee asked the council if they could get a bid on a steel roof for the building and the council agreed.

 

              Kelly Bolin, Sheriff Johnson, and area residents were present and discussed with the council the need for a change in street names and signs on Walnut Avenue by the bike trail.  There are two roads named Walnut Avenue, the one by the bike trail and one in the county approximately one-half a mile from the one by the bike trail.  There have been several incidents of problems with delivery trucks and at least one incident of a child dropped off of the school bus in the wrong area.  The council directed the city attorney to draw up an ordinance changing the name of Walnut Street by the bike trail. 

 

              Sheriff Johnson gave a presentation of how a tazer operates and also showed a video to the council about tazer operation.

 

              It was reported that the Medical Director of the Shell Rock Ambulance Service is mandating that the Shell Rock Ambulance change their level of service from an ambulance service to a first responder service.

 

              Ordinance Number 318 was introduced for its first reading by DeWitt seconded by Kliebenstein:  AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF SHELL ROCK, IOWA, 2003, BY AMENDING PROVISIONS PERTAINING TO THE EMERGENCY AMBULANCE SERVICE TO CHANGE THE LEVEL OF CARE TO A FIRST RESPONDER SERVICE.  Roll Call Vote:  Ayes-Bonzer, DeWitt, Kliebenstein, and Nieman.  Nays-None.  Absent-Meyer.  Motion carried.

 

              Motion by Nieman seconded by Bonzer to approve the proposal sheet for solid waste collection with the bids due back on October 30, 2009 at noon and the bid to be awarded at the November 3rd council meeting.  Ayes-Bonzer, DeWitt, Kliebenstein, and Nieman.  Nays-None.  Absent-Meyer.  Motion carried.

 

              Motion by Kliebenstein seconded by Bonzer to adjourn at 8:30 p.m.  Ayes-Bonzer, DeWitt, Kliebenstein, and Nieman.  Nays-None.  Absent-Meyer.  Motion carried.
