Regular Meeting Shell Rock City Council

                                   June 8, 2010

 

              Mayor Larry Young called the regular meeting to order at 7:00 p.m. in the City Hall with the Pledge of Allegiance.  Council members Donald Bonzer, James DeWitt, Glen Kliebenstein, and Rosalee Meyer were present.  Council member Benjamin DeWitt was absent.  There were two other people present. 

 

              Motion by Meyer seconded by Kliebenstein to approve the agenda with any additions.  Ayes-Bonzer, J. DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-B. DeWitt.  Motion carried.

 

              Motion by Kliebenstein seconded by James DeWitt to approve the consent agenda that included:  Minutes of May 4, 10, 17, and 19, 2010 and June 1 and 3, 2010, Payment of the Bills, the Financial Reports for the month of April, 2010, the Beer Permit for the 4th of July Committee, and the Cigarette Permit for Kwik Star.  Roll Call Vote:  Ayes-Bonzer, J. DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-B. DeWitt.  Motion carried.

 

              Mayor Young opened the public hearing at 7:01 p.m. for the purpose of public comment to consider an application for Rezoning from “R-1” Single Family Residential District to “C-2” Commercial District for the legal description as follows:  The West 465 feet of the North 17.58 Acres of the NE 1/4, NW 1/4, Section 12, T91N, R15W (Shell Rock Township) adjacent to Highway No. 3, in the City of Shell Rock, Butler County, Iowa.  There was one written objection and no oral objections and Mayor Young closed the hearing at 7:04 p.m. 

 

              Ordinance Number 327 was introduced by Kliebenstein seconded by Bonzer:  AN ORDINANCE AMENDING THE ZONING ORDINANCE OF SHELL ROCK, IOWA, PROVIDING FOR REZONING OF AN AREA FROM “R-1” SINGLE FAMILY RESIDENTIAL TO “C-2” COMMERCIAL DISTRICT.  Roll Call Vote:  Ayes-Bonzer, J. DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-B. DeWitt.  Motion carried.

 

              Motion by Kliebenstein seconded by Meyer to suspend the rules on the second reading of Ordinance Number 327 under Section 380.03, Code of Iowa, 2009, as amended.  Roll Call Vote:  Ayes-Bonzer, J. DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-B. DeWitt.  Motion carried.

 

              Ordinance Number 327 was introduced by J. DeWitt seconded by Kliebenstein:  AN ORDINANCE AMENDING THE ZONING ORDINANCE OF SHELL ROCK, IOWA, PROVIDING FOR REZONING OF AN AREA FROM “R-1” SINGLE FAMILY RESIDENTIAL TO “C-2” COMMERCIAL DISTRICT.  Roll Call Vote:  Ayes-Bonzer, J. DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-B. DeWitt.  Motion carried.

 

.             Motion by Meyer seconded by Kliebenstein to suspend the rules on the third reading of Ordinance Number 327 under Section 380.03, Code of Iowa, 2009, as amended.  Roll Call Vote:  Ayes-Bonzer, J. DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-B. DeWitt.  Motion carried.

 

              Ordinance Number 327 was introduced for its final reading by James DeWitt seconded by Meyer:  AN ORDINANCE AMENDING THE ZONING ORDINANCE OF SHELL ROCK, IOWA, PROVIDING FOR REZONING OF AN AREA FROM “R-1” SINGLE FAMILY RESIDENTIAL TO “C-2” COMMERCIAL DISTRICT.  Roll Call Vote:  Ayes-Bonzer, J. DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-B. DeWitt.  Motion carried.

 

              The results of the open burning survey were read as follows:  Votes for total ban on open burning 37.  Votes for open burning allowed only on certain days 38.  Votes for leaving open burning allowed 116.  Brenda Schmidt discussed the issue of banning open burning with the council.  The council tabled the issue until the July 6th council meeting. 

 

              The agreement with the Waverly Health Center was tabled.

 

              Motion by James DeWitt seconded by Bonzer to enter into a contract for services with VJ Engineering for Willow Tree Subdivision and the Shell Rock Industrial Park.  Ayes-Bonzer, J. DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-B. DeWitt.  Motion carried.

 

              Motion by Meyer seconded by Bonzer to close the required streets for the 4th of July celebration and the Cherry Street Bridge during the fireworks, if required.  Ayes-Bonzer, J. DeWitt, Kliebenstein, and  Meyer.  Nays-None.  Absent-B. DeWitt.  Motion carried.

 

              Ordinance Number 328 was introduced for its first reading by Bonzer seconded by James DeWitt:  AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF SHELL ROCK, IOWA, 2008, MAKING AN EXCEPTION TO THE REQUIREMENT FOR DIRECTIONAL REFERENCES FOR STREET NAMES FOR MASON WAY, LOZMAR LANE AND ELLIOT AVENUE.  Roll Call Vote:  Ayes-Bonzer, J. DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-B. DeWitt.  Motion carried.

 

              Resolution 030-2010 was introduced by Kliebenstein seconded by Bonzer:  A RESOLUTION SETTING WAGES FOR THE BENNY GAMBAIANI PUBLIC LIBRARY:  Effective July 1, 2010:  Library Director Deb Heidemann $11.61 per hour and Assistant Librarian Sue Kaus $8.50 per hour.  Effective and retroactive to May 26, 2010:  Library Aide Leslie Harding $7.25 per hour and Library Aide Marty Downing $7.25 per hour.  Roll Call Vote:  Ayes-Bonzer, J. DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-B. DeWitt.  Motion carried. 

 

              The council directed the clerk to have the city attorney draw up an ordinance banning pit bulls in the City of Shell Rock.

 

              Motion by Kliebenstein seconded by Bonzer to have the financial consultant draw up the paper work to issue General Obligation Bonds for $400,000 for the June 29, 2010.  Roll Call Vote:  Ayes-Bonzer, J. DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-B. DeWitt.  Motion carried.

 

              Motion by Bonzer seconded by Meyer to adjourn at 8:36 p.m.  Ayes-Bonzer, J. DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-B. DeWitt.  Motion carried.
