Regular Meeting Shell Rock City Council
January 5, 2010
Mayor Larry Young called the regular meeting to order in the City Hall at 7:00 p.m. with the Pledge of Allegiance. Mayor Young and Council Members Benjamin DeWitt and James DeWitt were all sworn into office on January 4, 2010. Council Members Donald Bonzer, Benjamin DeWitt, James DeWitt, Glen Kliebenstein, and Rosalee Meyer were present. There were six people in the audience.
Motion by Kliebenstein seconded by Benjamin DeWitt to approve the agenda with any additions. Ayes-Bonzer, B. DeWitt, J. DeWitt, Kliebenstein, and Meyer. Nays-None. Motion carried.
Motion by Meyer seconded by Benjamin DeWitt to approve the consent agenda that included: The minutes of December 8 & 21, 2009, the Payment of the Bills, and the Financial Reports for the month of November, 2009. Roll Call Vote: Ayes-Bonzer, B. DeWitt, J. DeWitt, Kliebenstein, and Meyer. Nays-None. Motion carried.
Mayor Larry Young made the following appointments for the calendar year 2010:
Mayor Pro Tem – Glen Kliebenstein
Police Chief – Louis Staudt
Bridge Committee – Benjamin DeWitt and Glen Kliebenstein
City Property Committee – Donald Bonzer and James DeWitt
City Clean Up Committee – Glen Kliebenstein and Rosalee Meyer

Finance Committee – Glen Kliebenstein and Rosalee Meyer
Street Committee – Benjamin DeWitt and James DeWitt

Motion by Meyer seconded by Bonzer to approve Mayor Young’s appointment of Robert Greenlee to the Butler County Solid Waste Commission for the calendar year 2010. Ayes-Bonzer, B. DeWitt, J. DeWitt, Kliebenstein, and Meyer. Nays-None. Motion carried.
Motion by Bonzer seconded by Kliebenstein to make the following appointments for the calendar year 2010:
City Attorneys – Karl Nelson and Bruce Toenjes
City Clerk/Treasurer – Marilyn Hardee
City Depository – Security State Bank
City Newspapers – Waverly Newspapers
Fire Chief – Dwayne Sessler
First Responder Crew Chief – David Green

Mayor Young immediately proceeded to administer the oath of office to City Attorney Bruce Toenjes, Police Chief Louis Staudt, City Clerk/Treasurer Marilyn Hardee, Fire Chief Dwayne Sessler, and First Responder Crew Chief David Green.
Resolution 001-2010 was introduced by Kliebenstein seconded by Meyer: A RESOLUTION OF THE CITY COUNCIL OF SHELL ROCK, IOWA, AUTHORIZING THE MAYOR TO SIGN A CONTRACT WITH THE IOWA NORTHLAND REGIONAL COUNCIL OF GOVERNMENTS (INRCOG) FOR THE ADMINISTRATION OF THE DEMOLITION PORTION OF IOWA HOMELAND SECURITY EMERGENCY MANAGEMENT DIVISION GRANT AGREEMENT NUMBER HMGP-DR-019 01/ PROJECT NUMBER DR-1763-12-01. Roll Call Vote: Ayes-Bonzer, B. DeWitt, J. DeWitt, Kliebenstein, and Meyer. Nays-None. Motion carried.
Motion by Kliebenstein seconded by Bonzer to authorize the Mayor to sign the Contract For Services Related to the Demolition of Flood Damaged Property Between the Iowa Northland Regional Council of Governments and the City of Shell Rock, Iowa. Ayes-Bonzer, B. DeWitt, J. DeWitt, Kliebenstein, and Meyer. Nays-None. Motion carried.
Resolution 002-2010 was introduced by Benjamin DeWitt seconded by Meyer: A RESOLUTION CHANGING THE NAME OF WALNUT AVENUE TO WRANGLER ROAD. Roll Call Vote: Ayes-Bonzer, B. DeWitt, J. DeWitt, Kliebenstein, and Meyer. Nays-None. Motion carried.
Ordinance No. 320 was introduced for its first reading by Kliebenstein seconded by Benjamin DeWitt: AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF SHELL ROCK, IOWA, 2008, MAKING AN EXCEPTION TO THE REQUIREMENT FOR DIRECTIONAL REFERENCES FOR STREET NAMES FOR WRANGLER ROAD. Roll Call Vote: Ayes-Bonzer, B. DeWitt, J. DeWitt, Kliebenstein, and Meyer. Nays-None. Motion carried.
Motion by Meyer seconded by Benjamin DeWitt to advertise for sale the 2005 Braun Ambulance Vehicle with the City of Shell Rock accepting sealed bids until April 5, 2010 with the minimum bid being $50,000.00 and the City of Shell Rock reserving the right to accept or reject any or all bids. Ayes-Bonzer, B. DeWitt, J. DeWitt, Kliebenstein, and Meyer. Nays-None. Motion carried.
Motion by Kliebenstein seconded by Bonzer to appoint Karen Fecht to the Library Board to finish the unexpired term of Beverly Moffitt. Ayes-Bonzer, B. DeWitt, J. DeWitt, Kliebenstein, and Meyer. Nays-None. Motion carried.
Mayor Young scheduled the first budget meeting for January 18, 2010 at 6:00 p.m.
The City of Shell Rock received thirteen applications for the water meter reader position. The Employee Relations Committee will set up some interviews and recommend to the Council a person for hire at the budget meeting.
The council was given a draft tree ordinance for review.
Ordinance No. 319 was introduced for its final reading by Kliebenstein seconded by Meyer: AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF SHELL ROCK, IOWA, 2008, BY AMENDING PROVISIONS PERTAINING TO COMMERICAL AND RESIDENTIAL SOLID WASTE COLLECTIONS FEES. Roll Call Vote: Ayes-Bonzer, Kliebenstein, and Meyer. Nays-B. DeWitt. Abstain-J. DeWitt. Motion carried.
