Regular Meeting Shell Rock City Council
March 2, 2010
Mayor Larry Young called the regular meeting to order at 7:00 p.m. in the City Hall with the Pledge of Allegiance. Council members Donald Bonzer, Benjamin DeWitt, James DeWitt, and Rosalee Meyer were present. Council member Glen Kliebenstein was absent. There were ten other people in the audience.
Motion by Meyer seconded by Bonzer to approve the agenda with any additions. Ayes-Bonzer, B. DeWitt, J. DeWitt, and Meyer. Nays-None. Absent-Kliebenstein. Motion carried.
Motion by Benjamin DeWitt seconded by James DeWitt to approve the consent agenda that included the following items: The minutes of February 2, 2010, Payment of the Bills, and the Financial Reports for the month of February, 2010, the Liquor License with Sunday Sales for The Cooler, and the Beer Permit with Sunday Sales for Kwik Star. Roll Call Vote: Ayes-Bonzer, Benjamin DeWitt, James DeWitt, and Meyer. Nays-None. Absent-Kliebenstein. Motion carried.
Mayor Young opened the public hearing at 7:02 p.m. for the purpose of public comment on the proposed Budget for the City of Shell Rock for the fiscal year beginning July 1, 2010 and ending June 30, 2011. There were eleven people present in the audience. There were no written or oral questions or objections and Mayor Young closed the public hearing at 7:03 p.m.
Resolution 006-2010 was introduced by Benjamin DeWitt seconded by Meyer: A RESOLUTION ADOPTING THE BUDGET AND CERTIFICATION OF CITY TAXES FOR THE CITY OF SHELL ROCK, IOWA, FOR THE FISCAL YEAR BEGINNING JULY 1, 2010 AND ENDING JUNE 30, 2011. Roll Call Vote: Ayes-Bonzer, B. DeWitt, J. DeWitt, and Meyer. Nays-None. Absent-Kliebenstein. Motion carried.
K.C. Moffitt was present and asked the council to forgive the loan promissory note executed by Beverly Moffitt on her house located at 112 E. Water Street since the house is going to be occupied by an immediate family member. Motion by Bonzer seconded by Meyer to transfer the Forgivable Loan Promissory Note executed by Beverly Moffitt to her daughter Linda Bingham and to have the note recorded where legally necessary. Ayes-Bonzer, B. DeWitt, J. DeWitt, and Meyer. Nays-None. Absent-Kliebenstein. Motion carried.
Larry Burger of Sperr Financial was in attendance and presented the council with the City of Shell Rock Tax Increment Financing District Planning Report. Mr. Burger also discussed the amending of the Urban Renewal Area for the Industrial Park on the east side of the city limits and developing a new Urban Renewal Area for the Willow Tree Subdivision.
Clay Reints was present, representing his parents, Jeff and Micki Reints and discussed the Willow Tree Subdivision Plans with the council. Motion by Benjamin DeWitt seconded by Bonzer to direct the City Staff to continue negotiations with Jeff and Micki Reints on the Willow Tree Subdivision and proceed with the Urban Renewal Area. Ayes-Bonzer, B. DeWitt, J. DeWitt, and Meyer. Nays-None. Absent-Kliebenstein. Motion carried.
Motion by Benjamin DeWitt seconded by James DeWitt to approve the proposal from Simmering-Cory, Inc. to develop an Urban Renewal Plan for the Willow Tree Subdivision and to an amendment drawn up for the Urban Renewal Plan for the Industrial Park. Ayes-Bonzer, B. DeWitt, J. DeWitt, and Meyer. Nays-None. Absent-Kliebenstein. Motion carried.
Resolution 007-2010 was introduced by Bonzer seconded by Meyer: A RESOLUTION APPROVING AN AMENDMENT OF THE CITY COUNCIL OF THE CITY OF SHELL ROCK, IOWA, ADOPTING A REVISION TO THE CONTRACT WITH NELSON & TOENJES LAW OFFICE TO ACT AS THE CLOSING AGENT FOR THE CITY FOR FLOOD BUYOUTS FUNDED UNDER IOWA HOMELAND SECURITY EMERGENCY MANAGEMENT DIVISION GRANT AGREEMENT NUMBER HMGP-DR-1763-0019 01/PROJECT NUMBER DR-1763-12-01. Roll Call Vote: Ayes-Bonzer, B. DeWitt, J. DeWitt, and Meyer. Nays-None. Absent-Kliebenstein. Motion carried.
Ordinance Number 322 was introduced by James DeWitt for its first reading and seconded by Meyer: AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF SHELL ROCK, IOWA, 2008, BY AMENDING PROVISIONS PERTAINING TO WATER RATES. Roll Call Vote: Ayes-Bonzer, B. DeWitt, J. DeWitt, and Meyer. Nays-None. Absent-Kliebenstein. Motion carried.
Ordinance Number 321 was introduced for its second reading by Benjamin DeWitt seconded by Bonzer: AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF SHELL ROCK, IOWA, 2008, MAKING REVISIONS TO CHAPTER 151, TREES, RELATING TO TREES AND THE CITY TREE BOARD. Roll Call Vote: Ayes-Bonzer, B. DeWitt, J. DeWitt, and Meyer. Nays-None. Absent-Kliebenstein. Motion carried.
Motion by Meyer seconded by James DeWitt to waive the fee for the Boyd Building rent for the 4th of July Committee for the Fireworks Brunch that was held on February 7, 2010. Ayes-Bonzer, B. DeWitt, J. DeWitt, and Meyer. Nays-None. Absent-Kliebenstein. Motion carried.
Police Chief Louis Staudt reported to the council complaints he has received on vehicles being parked on the 100 block of W. South Street and the 200 block of W. Main Street that obstruct the flow of traffic. Council will look at this issue further.
