Regular Meeting Shell Rock City Council

                                  March 3, 2009

 

              Mayor Larry Young called the regular meeting to order at 7:00 p.m. in the City Hall with the Pledge of Allegiance.  Council members Benjamin DeWitt, Glen Kliebenstein, Rosalee Meyer, and Steven Nieman were present.  Council member Donald Bonzer was absent.  There were seven other people in the audience.

 

              Motion by Kliebenstein seconded by Meyer to approve the agenda with any additions.  Ayes-DeWitt, Kliebenstein, Meyer, and Nieman.  Nays-None.  Absent-Bonzer.  Motion carried.

 

              Motion by DeWitt seconded by Meyer to approve the consent agenda that included:  The minutes of February 3, 2009, Payment of the Bills, and the Financial Reports for the month of January, 2009, Beer Permit with Sunday Sales for Kwik Star, and the Liquor License for The Cooler.  Roll Call Vote:  Ayes-DeWitt, Kliebenstein, Meyer, and Nieman.  Nays-None.  Absent-Bonzer.  Motion carried.

 

              Mayor Young opened the public hearing at 7:01 p.m. with seven people in the audience.  The purpose of the hearing was for public comment on the proposed budget of the fiscal  year beginning July 1, 2009 – ending June 30, 2010.  There were no oral or written objections and Mayor Young closed the public hearing at 7:03 p.m.

 

              Resolution 007-2009 was introduced by Kliebenstein seconded by Meyer:  A RESOLUTION ADOPTING THE BUDGET FOR THE FISCAL YEAR BEGINNING

JULY 1, 2009 – ENDING JUNE 30, 2010 AND THE CERTIFICATION OF TAXES.  Roll Call Vote:  Ayes-DeWitt, Kliebenstein, Meyer, and Nieman.  Nays-None.  Absent-Bonzer.  Motion carried.

 

              Motion by DeWitt seconded by Kliebenstein to waive the fee for the Boyd Building for the 4th of July Brunch of $66.40.  Ayes-DeWitt, Kliebenstein, Meyer, and Nieman.  Nays-None.  Absent-Bonzer.  Motion carried.

 

              Motion by Nieman seconded by Kliebenstein to approve a change in the Fire Protection Township Contracts stating that anything costing more than $2,500.00 must have a purchase order signed by the City Finance Committee and have the signatures from the Clerk’s of Beaver, Butler, Jefferson, and Shell Rock Townships.  Ayes-DeWitt, Kliebenstein, Meyer, and Nieman.  Nays-None.  Absent-Bonzer.  Motion carried.

 

              Motion by Kliebenstein seconded by Nieman to participate in a summer youth program under Camp Adventure offered through the University of Northern Iowa under Option 1, which is a two week session for a cost of $2,300.00.  Roll Call Vote:  Ayes-DeWitt, Kliebenstein, Meyer, and Nieman.  Nays-None.  Absent-Bonzer.  Motion carried.

 

              Motion by DeWitt seconded by Meyer to appoint Marjorie Pruin to the Planning & Zoning Commission with her term to expire August 31, 2010.  Ayes-DeWitt, Kliebenstein, Meyer, and Nieman.  Nays-None.  Absent-Bonzer.  Motion carried.

 

              Motion by Meyer seconded by Kliebenstein to approve the Historical and Geological Survey that will be done by Calhoun-Burns Engineering for an approximate cost of $15,000.00.  Roll Call Vote:  Ayes-DeWitt, Kliebenstein, Meyer, and Nieman.  Nays-None.  Absent-Bonzer.  Motion carried.

 

              Resolution 008-2009 was introduced by DeWitt seconded by Nieman:  A RESOLUTION AMENDING THE PERSONNEL POLICY OF THE CITY OF SHELL ROCK, IOWA, PERTAINING TO DENTAL INSURANCE.  Roll Call Vote:  Ayes-DeWitt, Kliebenstein, Meyer, and Nieman.  Nays-None.  Absent-Bonzer.  Motion carried.

 

              Resolution 009-2009 was introduced by Kliebenstein seconded by Meyer:  A RESOLUTION SETTING THE DATES AND FEES FOR SPRING CLEAN UP 2009. 

The dates for Spring Clean Up are April 20 – 22, 2009. Roll Call Vote:  Ayes-DeWitt, Kliebenstein, Meyer, and Nieman.  Nays-None.  Absent-Bonzer.  Motion carried.

 

              Resolution 010-2009 was introduced by Kliebenstein seconded by Meyer:  A RESOLUTION APPROVING THE WAGES FOR CITY EMPLOYEES FOR THE FISCAL YEAR STARTING JULY 1, 2009.  The following wages are effective July 1, 2009:  Police Chief Louis Staudt $40,369/year + 4th of July Celebration pay of $400.00, Public Works Director/Co-Zoning Administrator Mike Tellinghuisen $21.85/hour + overtime, Utility Worker David Green $14.54/hour + overtime, City Clerk/Co-Zoning Administrator Marilyn Hardee $37,879/year, Deputy City Clerk/Park Coordinator Rachel Nieman $14.39/hour, Meter Reader Barbara Hawley $2,709/year, Library Director Diane Harms $11.38/hour, Assistant Librarian Debra Heidemann $9.90/hour, Library Aide Susan Kaus $7.82/hour.  Remaining Pay to stay the same:  Person taking minutes is $40.00 per meeting.  Mileage reimbursement .43 per mile.  Ayes-DeWitt, Kliebenstein, Meyer, and Nieman.  Nays-None.  Absent-Bonzer.  Motion carried.

 

              City Attorney Bruce Toenjes stated to the council that Gary Mick had contacted him about the City of Shell Rock possibly purchasing the land owned by him between Linn Street and Graham Street and wanted to know if the council had any interest in purchasing that land for a continuation of McCague Memorial Park or if any entity would purchase the land and then work with the City of Shell Rock on expanding McCague Memorial Park.  The council had no interest in pursuing this land.

 

              Ordinance No. 313 was introduced for its second reading by DeWitt seconded by Kliebenstein:  AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF SHELL ROCK, IOWA, 2008, BY AMENDING PROVISIONS PERTAINING TO WATER RATES.  Roll Call Vote:  Ayes-DeWitt, Kliebenstein, Meyer, and Nieman.  Nays-None.  Absent-Bonzer.  Motion carried.

 

              Ordinance No. 314 was introduced for its second reading by Kliebenstein seconded by Meyer: AN ORDINANCE AMENDING CHAPTER 56 OF THE CODE OF ORDINANCES OF THE CITY OF SHELL ROCK, IOWA, PERTAINING TO DANGEROUS AND VICIOUS ANIMALS, BY EXCLUDING PIT BULL TERRIERS FROM THE DEFINITION OF DANGEROUS ANIMALS AND BY REQUIRING INSURANCE AND REGISTRATION FOR PIT BULLS.   Roll Call Vote:  Ayes-DeWitt, Kliebenstein, and Meyer.  Nays-Nieman.  Absent-Bonzer.  Motion carried.

 

              Ordinance No. 312 was introduced for its third reading by DeWitt seconded by Kliebenstein:  AN ORDINANCE PROVIDING THAT GENERAL PROPERTY TAXES LEVIED AND COLLECTED EACH YEAR ON ALL PROPERTY LOCATED WITHIN THE BUSINESS PARK URBAN RENEWAL PROJECT AREA, IN THE CITY OF SHELL ROCK, COUNTY OF BUTLER, STATE OF IOWA, BY AND FOR THE BENEFIT OF THE STATE OF IOWA, CITY OF SHELL ROCK, COUNTY OF BUTLER, WAVERLY-SHELL ROCK, COMMUNITY SCHOOL DISTRICT AND OTHER TAXING DISTRICTS, BE PAID TO A SPECIAL FUND FOR PAYMENT OF PRINCIPAL AND INTEREST ON LOANS, MONIES ADVANCED TO AND INDEBTEDNESS, INCLUDING BONDS ISSUED OR TO BE ISSUED, INCURRED BY THE CITY IN CONNECTION WITH THE URBAN RENEWAL REDEVELOPMENT PROJECT.  Roll Call Vote:  Ayes-DeWitt, Kliebenstein, Meyer, and Nieman.  Nays-None.  Absent-Bonzer.  Motion carried.

 

              Motion by Nieman seconded by Kliebenstein to adjourn at 8:15 p.m.  Ayes-DeWitt, Kliebenstein, Meyer, and Nieman.  Nays-None.  Absent-Bonzer.  Motion carried.
