Regular Meeting Shell Rock City Council

                                  July 7, 2009

 

              Mayor Larry Young called the regular meeting to order in City Hall at 7:00 p.m. with the Pledge of Allegiance.  Council members Donald Bonzer, Benjamin DeWitt, Glen Kliebenstein, and Rosalee Meyer were present.  Council member Steven Nieman was absent.  There were five people in the audience.

 

              Motion by Kliebenstein seconded by DeWitt to approve the agenda with any additions.  Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-Nieman.  Motion carried.

 

              Motion by Bonzer seconded by Kliebenstein to approve the consent agenda that included:  Minutes of June 2 & 24, 2009, Payment of the Bills, and the Financial Reports for the month of May, 2009.  Roll Call Vote:  Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-Nieman.  Motion carried.

 

              Mayor Young opened the public hearing at 7:02 p.m. with five people in the audience.  The purpose of the public hearing was for public comment to allow a previously constructed building to be moved from outside the city limits to a property located at 403 E. Grove Street.  There were no objections either written or oral and the owner of the property Roger Hirsch answered the council’s questions.  The hearing was closed at 7:06 p.m.

 

              Motion by DeWitt seconded by Bonzer to approve the moving in of the building to be located at 403 E. Grove Street provided that the building is resided once it is set on the property.  Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-Nieman.  Motion carried.

 

              Motion by DeWitt seconded by Meyer to reappoint James Willson to the Board of Adjustment with his term to expire June 30, 2014.  Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-Nieman.  Motion carried.

 

              The Boyd Building Committee reported that a new window is going to be put in the Legion Room.  The Fire Department reported that Engine 3 has two leaks in the tank; the Park Department stated there will be no “Operation Pride” summer camp this year, Police Chief Lou Staudt reported there were four burglaries for the month of June and there have been numerous mischievous acts in the shelter houses and pool this summer.

 

              Mayor Young opened the public hearing at 7:30 p.m. with five people present.  The purpose of the hearing was for public comment on the proposed rezoning from “R-1” Single Family Residential to “R-2” Low Density Residential District for the legal description as follows:  Lots 6,7 , and 8 in Block 2, of Williams Addition, Township 91, Range 15, in Butler County, Iowa.  Locally known to be in the 200 Block of E. James Street, Shell Rock, Iowa.  There were no objections either written or oral and the hearing was closed at 7:37 p.m.

 

              Ordinance Number 316 was introduced for its first reading by Bonzer seconded by Meyer:  AN ORDINANCE AMENDING THE ZONING ORDINANCE OF SHELL ROCK, IOWA, PROVIDING FOR REZONING OF AN AREA OF THE CITY FROM “R-1” SINGLE FAMILY RESIDENTIAL TO “R-2” LOW DENSITY RESIDENTIAL, LOCALLY KNOWN TO BE IN THE 200 BLOCK OF EAST JAMES STREET.  Roll Call Vote:  Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-Nieman.  Motion carried.

 

              The Industrial Park on the easterly city limits was discussed and the council stated that they want to pursue the infrastructure for the entire Industrial Park area.

 

              Ordinance No. 315 was introduced for its second reading by Kliebenstein seconded by DeWitt:  AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF SHELL ROCK, IOWA, 2008, BY AMENDING PROVISIONS PERTAINING TO COMMERCIAL AND RESIDENTIAL SOLID WASTE COLLECTION FEES.  Roll Call Vote:  Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-Nieman.  Motion carried.

 

              Motion by Meyer seconded by Kliebenstein to adjourn at 7:47 p.m.  Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer.  Nays-None.  Absent-Nieman.  Motion carried.
