Regular Meeting Shell Rock City Council
April 7, 2009
Mayor Pro Tem Glen Kliebenstein called the regular meeting to order in the City Hall at 7:00 p.m. with the Pledge of Allegiance. Council members Donald Bonzer, Benjamin DeWitt, Glen Kliebenstein, and Rosalee Meyer were present. Council member Steven Nieman was absent. There were six people in the audience.
Motion by DeWitt seconded by Meyer to approve the agenda with any additions. Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer. Nays-None. Absent-Nieman. Motion carried.
Motion by Meyer seconded by Bonzer to approve the consent agenda that included: The minutes of March 3, 2009, the payment of the bills, and the financial reports for the month of February, 2009. Roll Call Vote: Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer. Nays-None. Absent-Nieman. Motion carried.
Mayor Pro Tem Kliebenstein called the public hearing to order at 7:02 p.m. with seven people present. The purpose of the public hearing was to obtain public comment on the Shell Rock Comprehensive Plan (Update) to provide for a general plan for the physical development of the City of Shell Rock. There were no oral or written objections and the hearing was closed at 7:03 p.m.
Resolution 011-2009 was introduced by Bonzer seconded by DeWitt: A RESOLUTION TO ADOPT THE CITY OF SHELL ROCK COMPREHENSIVE PLAN (UPDATE). Roll Call Vote: Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer. Nays-None. Absent-Nieman. Motion carried.
Motion by Meyer seconded by DeWitt to authorize the Mayor to sign an agreement with the Red Cross to be able to use the Boyd Building in case of an emergency. Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer. Nays-None. Absent-Nieman. Motion carried.
Fire Chief Dwayne Sessler reported that the Fire Department was awarded a $1,700 Butler County Community Foundation Grant to purchase a gas detector.
There was a letter presented to the Council requesting the Little League Funds back that were presented to the City of Shell Rock last year when the Little League was run by the city. Little League is back to being run by volunteers and Justin Garman of the committee wrote the request. Motion by DeWitt seconded by Bonzer to donate $6,550.83 back to the Shell Rock Little League. Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer. Nays-None. Absent-Nieman. Motion carried.
Police Chief Louis Staudt reported to the Council that former Police Chief Lance Brown would like to purchase his old hand gun. Council decided that the gun should be put up for sealed bid with the city having the right to reject any or all bids. Motion by DeWitt seconded by Bonzer to donate former Police Chief Lance Brown’s Police Badge to him and to put the hand gun up for sealed bids to be opened at the May council meeting. Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer. Nays-None. Absent-Nieman. Motion carried.
Motion by DeWitt seconded by Meyer to waive the fee for the open swim on Thursday, July 2, 2009 for the kick off festivities for the 4th of July with the 4th of July Committee making an appropriate donation. Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer. Nays-None. Absent-Nieman. Motion carried.
Resolution 012-2009 was introduced by Bonzer seconded by Meyer: A RESOLUTION SETTING POOL WAGES FOR THE 2009 POOL SEASON. Pool Managers $8.75 per hour, Assistant Manager $8.00 to $8.50 per hour, New Lifeguards $7.25 per hour, Experienced Lifeguards $7.25 per hour plus .15 per year of experience, Aqua sizing Instructor $8.25 per hour plus .50 per year of experience with $13.25 maximum. Roll Call Vote: Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer. Nays-None. Absent-Nieman. Motion carried.
Resolution 013-200 was introduced by DeWitt seconded by Bonzer: A RESOLUTION SETTING FEES FOR THE 2009 POOL SEASON: Family Pass $90.00, Single Pass $55.00, Day Pass $2.50, Baby Pool $1.00, Lap Swim $1.50, $10 for 10 times, Aqua Sizing $21.00 for 8 week session, Pool Party $55.00 for 1 hour and $75.00 for 2 hours, Swimming Lessons $22.00 for Public Lessons (subject to change). Roll Call Vote: Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer. Nays-None. Absent-Nieman. Motion carried.
Public Works Director Mike Tellinghuisen reported that the trail to McCague Park will start being constructed within the next week.
Motion by Meyer seconded by DeWitt to donate $100.00 to Project Graduation. Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer. Nays-None. Absent-Nieman. Motion carried.
Resolution 014-2009 was introduced by Bonzer seconded by Meyer: A RESOLUTION TRANSFERRING FUNDS: From the Housing Rehab Fund to the General Fund $52,633.00. Roll Call Vote: Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer. Nays-None. Absent-Nieman. Motion carried.
Ordinance No. 313 was introduced by DeWitt seconded by Bonzer: AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF SHELL ROCK, IOWA, 2008, BY AMENDING PROVISIONS PERTAINING TO WATER RATES. Roll Call Vote: Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer. Nays-None. Absent-Nieman. Motion carried.
Ordinance No. 314 was introduced by Meyer seconded by Bonzer: AN ORDINANCE AMENDING CHAPTER 56 OF THE CODE OF ORDINANCES OF THE CITY OF SHELL ROCK, IOWA, PERTAINING TO DANGEROUS AND VICIOUS ANIMALS, BY EXCLUDING PIT BULL TERRIERS FROM THE DEFINITION OF DANGEROUS ANIMALS AND BY REQUIRING INSURANCE AND REGISTRATION FOR PIT BULLS. Roll Call Vote: Ayes-Bonzer, DeWitt, Kliebenstein, and Meyer. Nays-None. Absent-Nieman. Motion carried.
